Terms of service.

1. The agreement
These terms govern your use of the AskMyHRM platform and the AskMyHRM website. By creating an account or by signing an order form, your organisation agrees to these terms together with the Data Processing Agreement and any order form attached.
2. Use of the service
You may use AskMyHRM only for lawful purposes and in accordance with these terms. You may not attempt to bypass tenant isolation, access another customer's data, reverse engineer the platform, or use the platform to violate applicable law.
3. Data ownership
You retain ownership of all customer data and content you submit to the platform. We process that data only as your processor under the DPA.
4. Service availability
Target availability is published in the service level annexe to the order form. We maintain disaster recovery and business continuity processes appropriate to the service tier.
5. Fees
Fees are set in the order form. They are charged in advance on a recurring basis unless otherwise agreed. Fees exclude VAT.
6. Term and termination
The initial term and renewal mechanism are set in the order form. Either party may terminate for material breach if the breach is not cured within thirty days of written notice.
7. Liability
Each party's aggregate liability is limited to the greater of (a) the fees paid by the customer to AskMyHRM in the twelve months preceding the event giving rise to the claim, or (b) a fixed floor of EUR 100,000 for claims involving personal data under GDPR / AVG (including special categories under Art. 9) or breach of confidentiality. Claims arising from gross negligence or wilful misconduct remain uncapped.
7b. AI output ownership and warranty
The customer owns all outputs produced by the AI specialists on its tenant. AskMyHRM does not train any foundation or shared AI model on customer data (see DPA §11). AI outputs are provided "as generated" — substantive decisions should be reviewed by a human; AskMyHRM warrants source citation and audit traceability, not the legal correctness of any specific HR judgment.
8. Governing law
These terms are governed by Dutch law. The competent court in Amsterdam has exclusive jurisdiction over any dispute, subject to any mandatory consumer protections.
